Where Do OSHA Fines Go?

One of the most common questions about OSHA penalties

U.S. Treasury General Fund

100%

All OSHA penalty payments go directly to the U.S. Treasury General Fund. Unlike some state programs, federal OSHA does not retain penalty revenue for its own operations or redirect it to workplace safety programs.

State OSHA Programs

Varies

The 22 states and territories with their own state-administered OSHA programs (like Cal/OSHA) may handle penalty revenue differently. Some states direct funds to worker safety training programs or compensation funds.

Workers/Victims

0%

OSHA fines do NOT compensate injured workers. Workers who are injured on the job must pursue workers' compensation claims or personal injury lawsuits separately from any OSHA enforcement action.

How to Reduce OSHA Fines

Up to 25%

Good Faith

Demonstrated commitment to safety through written programs, training records, and proactive hazard identification.

Up to 60%

Company Size

Small businesses (1-25 employees) receive up to 60% reduction. 26-100 employees: up to 40%. 101-250: up to 20%.

Up to 10%

History

No serious, willful, or repeated violations in the past 5 years qualifies for a history-based reduction.

Up to 50%

Quick Fix Agreement

Correcting hazards during or immediately after inspection. Agreeing to accelerated abatement timelines.

Varies

Informal Conference

Request an informal conference with the Area Director within 15 working days to discuss the citation and negotiate penalties.

The OSHA Citation Contest & Appeal Process

You have 15 working days to respond to a citation. Here is exactly what happens at each stage — and where most penalty reductions come from.

Day 0 — Citation issued
OSHA mails the citation with a proposed penalty, abatement date, and right-to-contest notice. The clock starts the day you receive it. You must post the citation at or near the site of each violation for 3 working days or until corrected (whichever is longer).
Days 1–15 — Informal conference window
Request an informal conference with the OSHA Area Director. This is the highest-ROI step. Roughly 60% of citations are reduced or reclassified here through good-faith and quick-fix arguments. Bring your written EAP, training records, and proof of corrective action — including the freshly regenerated evacuation map.
Day 15 — Notice of Contest deadline
If unresolved, you must file a written Notice of Contest within 15 working days or the citation becomes a final order with no further appeal. Late filings are almost never accepted.
Weeks 4–12 — OSHRC settlement
The case goes to the Occupational Safety and Health Review Commission (OSHRC). A Solicitor of Labor attorney typically reaches out for settlement. Most contested cases settle here, often with further reductions in exchange for accelerated abatement.
Months 3–18 — Hearing before an ALJ
If no settlement, an Administrative Law Judge holds an evidentiary hearing. You can be represented by an attorney or yourself. The judge issues a written decision.
Months 18+ — Commission + federal court review
Either party can ask the full Commission to review the ALJ decision, then a US Court of Appeals. Very few cases reach this stage and they get expensive fast.

Bottom line: the cheapest way to reduce a citation is to fix the hazard immediately and show up to the informal conference with proof. For evacuation-map and EAP findings, that proof is a freshly regenerated, posted map — typically a 5-minute job that can knock $5,000+ off a settlement.
